Sigfyn operates a website and mobile application accessible on smartphones, tablets, desktops, and laptops, collectively referred to as the “Platform” or “Application”.

The Platform enables you to track, save, and grow your wealth by consolidating your entire financial life - including investments, loans, credit cards, and taxes - into a single app. By accessing, visiting, or using our Platform, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, you may not use the Services in any manner.

Who We Are

The services under the Sigfyn brand are provided by different legal entities based on the nature of the service. The entity responsible for processing your personal data depends on the service you use.

Sigfyn Investment Advisors Private Limited

Nature of Service

SEBI-registered Investment Advisor offering investment advisory, wealth management, and financial planning services.

Data Handling

Processed and managed whenever you engage with our advisory services.

Nature of Service

AMFI-registered mutual fund distributor. Uses MF Central to consolidate your portfolio and enable new investments.

Nature of Service

Owns the technology platform - app/website development, infrastructure, support, analytics, and security.

02User Obligations

Terms of Use

By using the Platform, you explicitly agree to the following conditions:

Provide accurate, current, and complete information as required for registration, regulatory KYC compliance, and service utilisation.

2.

Maintain the absolute confidentiality of your account credentials and notify us immediately of any unauthorised access or security breach.

3.

Use the Platform and its services only for lawful purposes and in strict accordance with all applicable local, national, and international laws.

4.

Ensure that your investment transactions comply with the Income Tax Act, anti-money laundering regulations, and all other relevant guidelines.

Sigfyn reserves the right to suspend, restrict, or terminate your account immediately if any suspicious, fraudulent, or unlawful activity is detected.

03Integrations

Third Party Services

Our Platform may link to or integrate with third-party websites or services (such as mutual fund asset management companies, banks, or payment gateways). Sigfyn does not control, verify, or endorse third-party content and is not liable for any loss or damage arising from your interactions with these third parties.

04Privacy Link

Data Privacy & Protection

By using our Platform, you agree to the processing of your personal data as outlined in our Privacy Policy. We utilise third-party services such as Google Analytics and Microsoft Clarity to improve user experience. These services may collect data like session activity, device specifications, and location metadata.

05Liability Cap

Limitation of Liability

Sigfyn, its directors, employees, or partners shall not be held liable for:

Any direct, indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Platform.

Loss of data, profiles, business profits, or investment performance due to reliance on our services or advisory calls.

Any third-party services, actions, or transactions conducted via bank payment gateways.

06Transactions

Refund & Cancellation

Failed Transactions

In case of a failed mutual fund transaction, refunds will be automatically processed to your registered bank account within 6-7 business days.

Allotted Units

Once mutual fund units are officially allotted, transactions cannot be cancelled. Withdrawal requires a standard redemption request as per AMC policy.

07Jurisdictional Terms

Dispute & Governing Law

Arbitration

Any dispute arising under these Terms shall be subject to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bangalore, India.

Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any legal proceedings shall be exclusively brought in the courts of Bangalore, India.

08Asset Ownership

Intellectual Property Rights

All content, design patterns, features, logos, and functionalities available on the Platform are the exclusive property of Sigfyn or its licensors and are protected by applicable intellectual property and copyright laws. Unauthorised reproduction, copying, or reverse engineering without prior written consent may result in strict legal action.

09Miscellaneous Clauses

General Provisions

Disclaimers

All investments are subject to market risks. Read all scheme related documents carefully. Past performance is not an indicator of future returns.

Severability

If any provision of these Terms is held to be illegal or unenforceable, it will be replaced with a provision that has as far as possible the same legal and commercial effect. All remaining provisions continue in full force.

Waiver

Any failure on the part of Sigfyn to require performance of any provision shall not affect its right to full performance thereof, nor constitute a waiver of any future or similar breach.

Force Majeure

The Company shall not be liable for failure to perform obligations during events beyond its reasonable control, including unavailability of communication systems, power shutdowns, or telecommunication failures.

Notices

All notices from the Company will be served by email to your registered address or by general notification on the Platform. Any notice to Sigfyn should be sent to contact@sigfyn.com.

Changes to Terms

Sigfyn reserves the right to modify these Terms from time to time. Continued use of the Platform after any changes means you accept the revised Terms.
